Amber Portwood of the MTV reality series "Teen Mom" has chosen five years in jail over a court-ordered drug program.
In court on May 23, the 22-year-old reality star told the judge that she has not given up drugs and would rather go to jail than continue the treatment program.
"Amber finally had enough. The system failed her, and that is all I can say," her brother Shawn Portwood told E! News. "I really feel for my sister. She does not deserve to be there or anything that has happened to her. She is there because of who she is."
The judge accepted her plea and sent Portwood to the Madison County jail in Indiana. She will remain in jail until her sentencing in a few weeks.
Portwood was released from jail last Thursday, after she missed a court appointment to address charges stemming from her December 2011 drug arrest.
Portwood was also arrested on December 27, 2010, on charges of felony domestic battery and child neglect. In June 2011, she was put on probation and given a suspended two-year jail sentence for assaulting her ex-fiance Gary Shirley, the father of her 3-year-old daughter Leah. She was accused of assaulting him in front of their child in 2009 and was seen hitting him on a September 2010 episode of "Teen Mom."
In December 2011, she was arrested again, this time on charges of possession of a controlled substance and a probation violation. Portwood was found in possession of prescription drugs. She pled guilty and was taken into custody at an Indiana jail. In January 2012, her lawyer struck a plea deal that would call for her to be sent to rehab rather than be sentenced to prison for five years. In February, the deal was accepted.
She was ordered to complete a drug rehab program, which would last a maximum of three years, while the 5-year jail sentence would have been postponed and she would most likely not have had to complete it after fulfilling the requirements for her treatment.
The final season of "Teen Mom" premieres on June 12 at 10 p.m. ET on MTV.
